1. Acceptance of Terms
By accessing our website and engaging our services, you agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.
2. Description of Services
EliteHacker provides specialized cybersecurity services, including but not limited to penetration testing, adversary emulation (Red Teaming), managed detection and response (MDR), and compliance auditing. Detailed scopes of work, methodologies, and specific deliverables for these services will be defined in a separate Master Services Agreement (MSA) and Statement of Work (SOW) executed between EliteHacker and the Client.
3. User Obligations and Authorization
As a condition of engaging our offensive security services (e.g., penetration testing), you represent and warrant that:
- You have the legal authority to authorize testing against the targeted networks, applications, and physical premises.
- You have secured all necessary permissions from third-party hosting providers (e.g., AWS, Azure) prior to the commencement of any testing.
- You will not use our services for any illegal or unauthorized purpose, nor violate any laws in your jurisdiction (including but not limited to the Computer Fraud and Abuse Act or equivalent international statutes).
4. Intellectual Property Rights
Unless otherwise stated, EliteHacker and/or its licensors own the intellectual property rights for all material on EliteHacker. All intellectual property rights are reserved. You may access this from EliteHacker for your own personal use subjected to restrictions set in these terms and conditions.
You must not:
- Republish material from EliteHacker
- Sell, rent, or sub-license material from EliteHacker
- Reproduce, duplicate or copy material from EliteHacker
- Redistribute content from EliteHacker (unless content is specifically made for redistribution)
5. Confidentiality and Non-Disclosure
Due to the sensitive nature of our work, all findings, vulnerabilities discovered, and methodologies employed during an engagement are strictly confidential. Both EliteHacker and the Client agree to protect this information under the terms of a mutually executed Non-Disclosure Agreement (NDA). EliteHacker will never publicly disclose Client vulnerabilities without explicit written consent.
6. Disclaimers and Inherent Risks
Cybersecurity testing carries inherent risks. While EliteHacker utilizes highly trained operators and controlled methodologies to minimize operational impact, you acknowledge that network scanning, exploitation, and adversary emulation can potentially cause system instability, data corruption, or temporary denial of service.
The materials on EliteHacker's website are provided on an 'as is' basis. EliteHacker makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
7. Limitation of Liability
In no event shall EliteHacker or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on EliteHacker's website or the execution of our cybersecurity services, even if EliteHacker or an EliteHacker authorized representative has been notified orally or in writing of the possibility of such damage.
8. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of the State of California, United States, and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location for the resolution of any disputes.
